Terms and conditions

CONTRACT CONCLUSION
With the verbal or written registration (i.e. the booking from the customers on this page or on third party pages where this company services are advertised) in which Moro rent / Korcula rent (in text Korcula rent) or one of their businesses can execute, a binding contract exists between the customer and the organizer. Through the booking, the customer acknowledges the general business conditions as part of the contract between himself and the organizer.

OBJECT OF THE AGREEMENT
The organizer assumes responsibility for providing the requested service as described in the advertisements and/or in the confirmation order. Service extensions can be considered upon consultation with the organizer. Any extra costs will be borne by the customer.

PRICES
The effective prices for the offered activities can be drawn from the current advertisements from the organizer. The prices on the web page are quoted per boat in Euro and include the statutory value tax. Prices are subject to change. The booked activities are to be paid before the commencement of the trip.

CANCELATION POLICY
Cancellations of contracts must be in writing. Cancellations are only valid after consulting with the organizer and obtaining their agreement. In case of full cancellation of the reservation, refund may be obtained if:

Canceled in 30 days and more before date: 100% refund

Canceled in 15 days and more before date: 50% refund

Canceled within less then 15 days: Refund is not possible.

Why the cancellation fees? Our staff arrives early to prep yourboat to ensure an amazing experience. Cleaning and filling the boats requires several supplies and a few hours. Due to the nature of our rentals, time slots are booked ahead of time and a late cancellation means other potential guests may miss the opportunity to book. To ensure efficient scheduling for our staff and other guests we require a notice to cancel or change your booking.

In the case of the third party suppliers, the cancellation conditions of the respective supplier apply. These potential costs can be additionally added to the bill.

The customer is not entitled to a refund in the event of a later start or an early departure from the activity. Extra costs incurred due to a later start, an early departure, or the postponement of an activity, are to be paid by the customer. In the event of a postponement or change of date of an activity up to 30 days before trip begin, the organizer is entitled to charge a handling fee of 10% of the total arrangement price per person. Postponements or changes of date less than 30 days before trip begin will be charged in accordance with the above cancellation conditions or based on the effective resulting costs. In case of severe weather when it is unsafe to depart, customer can apply for a refund. The severe weather conditions should be stated clear in writing by Local Port Authority. Personal impression of weather conditions due to inexperience will not be taken into account.

RENTER OBLIGATIONS

RENTING A BOAT WITHOUT A SKIPPER
The Renter needs to know that the boat is only for private use, and that boat and equipment should be treated with care:
– Do not leave the boat in third party care,
– Do not transport persons or objects for a fee,
– Do not take more people than what is stated in the crew list on board,
– Do not take any undeclared goods on board
– To declare imported and exported goods in accordance with the rules applicable to the Renter´s  whereabouts,
– To comply with laws and regulations of the country the Renter’s whereabouts
– Do not participate in contests or regattas with the boat,
– At salvage, look at the salvage contract before accepting help from others.
– At salvage- make a contract with the salvage team before accepting help,
while signing the agreement with Korcula rent.

If the Renter does not follow these rules then the person in charge is fully responsible for the consequences, and Korcula rent will not be held responsible.

To get the boat rental in Croatia you will need a valid proof of knowledge (a sailing licence or certificate) as a coastal skipper, and VHF Certificate in English for at least one person on board. Only the person whose qualifications match the criteria should be the boat’s skipper. The certificates must be carried at all times in its original during the trip. Korcula rent assumes no financial responsibility if the certificate is missing or invalid. Korcula rent follows navigation regulations regarding nautical competence. Please check with your nautical authorities if you are unsure if your certificate or license is valid. Skippers can be rented if you are lacking the adequate nautical experience.

The boat is available from 9:00 on the day of departure. The boat should be back at the base no later than 18:00. Staying overnight onboard the boat is not allowed.

If the boat not is returned in time, regardless of weather conditions the Renter must pay double rent fee for the time delay per day. In addition, the Renter must reimburse Korcula Rent for costs imposed on the company if the next guest cancels their boat hire. Should the person that rented the boat, for some reason attributable to Korcula rent, end their journey in other harbour than the agreed port, the company shall be notified immediately. If the person who is responsible for the boat leaves it somewhere else, he/she must hand it over to another crew member with certificate and knowledge, until Korcula rent crew can take over the boat. The boat is returned after it has been inspected by Korcula rent and/or his/her delegate. The Renter is liable to pay costs which may arise in the aforementioned situation.

Before the Renter can get access to the boat he/she and the skipper must sign a contract with Korcula rent staff who is responsible for check in, and must carefully review the boat and equipment according to an inventory list. If the Renter finds no flaws in the boat or equipment the Renter shall, by signing, approve the inventory list. After these documents are signed, the boat’s liability is assumed by the skipper. If the guests cannot leave the base or home port, Korcula rent has the right to make repairs and/or additions without compensating the guest for the lost sailing time. Subsequent complaints regarding the boat or equipment may not then be relied to a greater extent than is provided below. The same applies to the boat’s electrical equipment and instruments.

Upon check out, the boat should be in a suitable condition, which means, accessible and clean both on the inside and on the outside, i.e., that the boat must be empty of both garbage and belongings. It’s also very important that the equipment on the boat is in its right place and that the dishes are taken care of (i.e. clean). If the boat is not found in that condition, there will be a fine of 50,00 €/hour for the extra work the Korcula rent staff needs to put into.
The boat must be returned with a full tank. Lost, damaged or unusable equipment must be reported upon arrival to the person in charge of check out. If the tank is not full, the Renter must reimburse Korcula rent with the refuelling cost + 20€ service. If the boat is returned in an unacceptably dirty condition, cleaning fee of 100€ will be charged to the Renter.

Before the Renter gets access to the boat, a deposit will be paid. The amount is shown on the booking confirmation and/or invoice. The deposit must be paid in cash, or otherwise agreed. The deposit will be returned after inspection of the boat, its equipment and inventory on site by Korcula rent staff, if they don’t find any damages to the boat. If equipment is missing or damages to the boat have occurred, the deposit will be withheld, fully or partially, depending on the severity of the damages, until the final cost has been determined (if the immediate solution is not possible). Repair and replacements costs are then deducted from the deposit.

Should any damage occur by normal weather conditions and normal use during the rental period the Renter is responsible to make necessary repairs as soon as possible. Repair costs will be reimbursed later by the Lessor upon presentation of a receipt. Replaced parts must be maintained.

In case of major damages, delays, loss of the boat, the inability to navigate the boat, if the boat is being seized by an authority or third party, a member of Korcula rent team and a local representative must be notified immediately. The Renter must take the necessary measures to limit the damage and negative consequences (for example, economic losses) and document, monitor, and in agreement with the Renter, spend money for potential repairs.

If the Renter is partly or fully responsible for damages under circumstances described above or has violated the terms of this agreement, the Renter shall compensate Korcula rent for expenses, potential losses and other direct or indirect damages caused by the Renters actions. In case of personal injury or damage to the boat, the Renter must write a report and obtain report from a third party, such as harbour master, doctor or naval inspector.

If damages cannot be repaired during the trip, and the circumstances allow the boat to be navigated, the Renter must return to home port before the lease period has expired and Korcula rent must be notified about the damages which have occurred, so that they can be able to repair them.

By violating any of the paragraphs above, the Renter is required to compensate Korcula rent for all the damages and costs Korcula rent has suffered due to breach of contract. If Korcula rent is held liable to third parties because of the Renter’s actions, the Renter shall reimburse the company for costs that may have occurred as a result of such action. If anything is lost or damaged on the boat during the rental period, the Renter should bear costs for replacements or repairs, but if the damage is caused by normal wear and tear then no cost will be added. The Renter is responsible for costs not covered by insurance and consequential costs, due to intentional or grossly negligent acts.

If damage is reported too late or incompletely that the insurance cannot be reinforced by Korcula rent team, the Renter will be held fully responsible for the costs.

RENTING A BOAT WITH A SKIPPER
The Renter needs to know that the boat is only for private use, and that boat and equipment should be treated with care:
– Do not leave the boat in third party care,
– Do not transport persons or objects for a fee,
– Do not take more people than what is stated in the crew list on board,
– Do not take any undeclared goods on board
– To declare imported and exported goods in accordance with the rules applicable to the Renter´s  whereabouts,
– To comply with laws and regulations of the country the Renter’s whereabouts
– Do not participate in contests or regattas with the boat,

If the Renter does not follow these rules then the person in charge is fully responsible for the consequences, and Korcula rent will not be held responsible.

The skipper in this case is only in a position of a licensed driver of a boat, and takes inputs of the renter. The skipper and Korcula rent are not responsible for renter’s whereabouts and activities during the trip.
The renter is advised to comply (but not binded) to skippers recommendations during the trip duration.

CLAIMS

Article 5 (4) of the European Package Travel Directive: “Any deficiencies in the performance of the contract observed on the spot by the consumer must be reported as soon as possible”.

Also, the customer must formulate, on the spot, as soon as possible his complaint with the local representative so as not to suffer the inconveniences during all the duration of his trip. If the customer does not obtain satisfaction, he must ask the representative for a certificate of service not provided. In the absence of this certificate, Korcula rent can not guarantee the favorable outcome of the claim that it would be formulated. Any unused service that has been subscribed and that has not been canceled before departure can not be refunded without the express agreement of the partner concerned.

Upon his return, the customer must make his claims of default to the Korcula rent in writing within 24 hours after the end of the trip accompanied by all original supporting documents (transport ticket, certificate of service not provided, copy of contract, etc.). The investigation of the complaints will relate only to the contractual elements of the reservation to the exclusion of any subjective appreciation. The response time will depend on the duration of the investigations conducted with the provider. In the absence of a satisfactory response within the 60-day period, the client may refer the matter to the Courts of Republic of Croatia.

INSURANCE

The liability of Korcula rent is covered by Insurance (Contract No. on request).
There is no insurance or assistance included in your trip. For your comfort, we invite you to subscribe to additional insurance offered by another party.

Passengers are strongly advised not to bring valuables but only effects that are necessary and appropriate to the specific purpose and conditions of the trip. Korcula rent draws the attention of its customers to the fact that it can not under any circumstances be responsible for the theft, degradation, loss or forgetfulness of the personal effects of the passengers and that it does not take care of their search or repatriation.

In general, the customer can not claim the loss of time or expense resulting from defects and failures that occur on-site, unless they result from blatant negligence of the local service provider.

The Korcula rent should not be held responsible for onshore activities by the renter.

CASE OF FORCE MAJURE

Force majeure means declared or undeclared wartime events, general strike, epidemic diseases, quarantine, fire, exceptional floods, accidents or other events beyond the control of two parts. Neither party will be held responsible for the delay due to force majeure events. In case of force majeure, found by one of the parties, it must inform the other party as soon as possible in writing or email. The other party will have ten days to see it.

ANIMALS

Pets will only be allowed to the extent that their presence has been specifically specified and accepted at the time of validation.

INTEGRITY OF THE CONTRACT

The present general conditions as well as the special conditions and all its annexes constitute the entire travel contract.
